How does it work?

There are three (3) payment available to you for using Seeflow’s services. You can activate one, two or all three options for your account. You are required to select and enable a minimum of one option. Once a payment option has been activated, by providing the necessary details for verification, you are able to select any of the activated options for each translation request.

Only activated payment options will be available for your selection when submitting a translation request.

Only one payment option can be selected per job.

Workbridge:

If your translation is related to your work, you may be eligible for Workbridge funds to cover the costs of the translation. You may be self-employed, or working for others.

If you have not yet done so, you will need to register with Workbridge to be eligible for funds, such as the Job Support fund, which can cover work-related expenses such as interpreters, note-takers and Seeflow translations.

By selecting this option and providing the required details, you are giving Seeflow permission to contact Workbridge on your behalf and confirm that you are registered, and that sufficient funds are available to complete your request. If there are sufficient funds to complete the translation, we will go ahead and complete the job and invoice Workbridge. All personal information about you held by Workbridge is confidential, and we do not need to know any other information, only that you are registered and have enough funds remaining for the job to proceed.

We can forward you a copy of the invoice upon request. We can also provide regular statements if you prefer so you can easily monitor your usage and remaining funds.

If you are not registered with Workbridge, or have insufficient remaining funds to cover the cost of the translation, we will contact you immediately, allowing you to decide how to proceed.

Employer:

If you are in paid or voluntary employment, your employer may be willing to cover the cost of your translation requests.

By selecting this option and providing the required details, you are giving Seeflow permission to contact your employer to confirm employment and that they agree to cover the cost of requested translations. We do not ask or discuss any other information about you other than confirming employment, and agreement to fund the translation(s).

Alternatively, you may prefer to confirm this with your employer and provide us with a letter of confirmation. If your employer refuses to fund any translation work, we will inform you of this situation, and this payment option will be removed from your account.

Some employers prefer to be asked to confirm each individual translation request, while others may prefer to confirm a series of translations, sometimes up to a maximum amount per calendar month or year. We can work with you and your employer to find the best way to keep you both informed of charges and remaining funds.

Sometimes employers decide to take the initiative and contact us directly to arrange translations. This means your access to the workplace improves without you having to arrange it. In this case we normally deal exclusively with the employer regarding invoicing.

Personal:

Some or all of the translations you request may not be work-related, instead they are personally requested by you for your own use. This may include correspondence such as family letters, or other personal documents or correspondence addressed to you, where translation is not funded by an organisation.

By selecting this option, you are allowing Seeflow to undertake translation work, with the intention of charging you personally for the cost. As for all Seeflow work, we can provide quotes in advance of commencing the translation if requested.

It is important to note that when you select this option, you are liable for the costs incurred, regardless of whether you believe the translation should be covered by a third party.

Terms and Conditions

These Terms and Conditions form a legal contract between you and Deafradio (provider of Seeflow) for your use of seeflow.co.nz. By using this website and purchasing services from us, you accept these Terms and Conditions. You may wish to print this page for your reference.

You should read these Terms and Conditions in conjunction with our Privacy Policy.

a) General Terms of Use

1. Your rights of use

You have the right to access and use seeflow.co.nz provided you comply with these Terms and Conditions. If you breach any part of these Terms and Conditions, we reserve the right to cancel your access to seeflow.co.nz

The content of seeflow.co.nz is for your personal use only. You must not share this service with any other person or organisation. Special conditions apply for organisations that wish to provide access to seeflow.co.nz to their members or employees. Please address all requests for corporate memberships to access@seeflow.co.nz.

You agree not to interrupt or attempt to interrupt the operation of seeflow.co.nz in any way. Seeflow reserves the right, without notice, to suspend, cancel and/or refuse an account where it believes activities of an individual or organisation is with the purpose of negatively affecting the efficiency or effectiveness of Seeflow services.

2. Accessing material

You are allowed to view and download translations from seeflow.co.nz for your own personal use. Registered members are also allowed to submit translations and grammar checking for their own personal use, or for the use of their clients, for which Deafradio is entitled to charge a fee. (Where members distribute access codes to their clients to access a translation via seeflow.co.nz, there may be additional charges incurred per viewing).

Where translations (excluding solely grammar checked work) is to be downloaded for viewing on another website belonging to an individual or organisation, or for the means of distribution via any other format including DVD, YouTube, or any electronic means of distribution, reference must be made to the fact that this work has been undertaken by Seeflow. This can be in the form of the digital watermark on the video at all times, or a written statement and/or approved brand image displayed prior to the commencement of the video stating, “The following translation is by seeflow.co.nz”. While we are very supportive of translated information reaching people for means of improved access, we must retain the integrity of our company and brand.

3. Errors and updates

We reserve the right to add or remove material from the seeflow.co.nz website, and correct errors. If you find any errors on any part of seeflow.co.nz, please report them to us.

4. Links to other sites

Links within seeflow.co.nz, including advertisements, are provided for your information. We do not endorse and have not necessarily verified any of the information available through the use of any link found within seeflow.co.nz. We accept no liability for any loss caused as a result of any information or opinion contained in any link found within seeflow.co.nz.

5. Privacy and Security

When you become a member of seeflow.co.nz or purchase one of our services, you will be set up with a member account. All personal information we collect about you passes through our secure server. We will keep all your personal information confidential. We will not sell or give any of your personal information to a third party without your permission. For more information about how we use and store your personal information, please read our Privacy Policy.

6. Complaints

If you have any complaints about the seeflow.co.nz service, please Contact Us. Seeflow will treat all complaints in confidence, and keep you informed of any and all investigations in relation to your complaint.

7. Changes to Terms and Conditions

We may change these Terms and Conditions at any time, without notice. Each time you log into seeflow.co.nz you are agreeing to the Terms and Conditions applicable at that time. We provide a link to these Terms & Conditions on your billing page.

8. Jurisdiction

The laws of New Zealand apply to these Terms and Conditions. Any dispute arising in relation to these terms and conditions will be resolved in accordance with New Zealand law.

9. Consumer Guarantees Act

Nothing in these Terms and Conditions limits your rights under the Consumer Guarantees Act 1993.

b) Seeflow membership

10. Your personal information

You agree to provide us with accurate and complete personal information necessary to activate your free Seeflow membership. This includes:

  • Your name
  • Email address
  • Postal address
  • Contact telephone number

11. Your obligations

You agree not to sell, assign or transfer your rights as a seeflow.co.nz member. You agree to pay the costs of personally requested work submitted to seeflow.co.nz, and work undertaken at your request that is not paid by a third party, and any other charges (including Internet connection charges) you incur in order to access seeflow.co.nz.

12. Your username and password

As part of the registration process, you will use your email address as a username and select a password. You will use your username and password to gain access to seeflow.co.nz.

13. When your Seeflow membership begins

When your membership has been processed and your membership activated, we will confirm by:

  • An email will be sent your nominated email address, informing you that your membership is ready for activation, and provide a link to complete the activation process.

Your access to seeflow.co.nz begins from the date on this activation message.

14. Security and unauthorised use

You must keep your password confidential. You are responsible for ensuring there is no unauthorised use of seeflow.co.nz under your password. You agree to notify us promptly if:

  • You suspect unauthorised use of your seeflow.co.nz access or;
  • Know or suspect loss or disclosure of your password.

You are liable for any unauthorised use of your online membership until you notify us and update your password. To be clear, this means if another person fraudulently uses your email address and password to request work, which is then commenced prior to us being informed that your details have been compromised, then you may be liable to cover the cost incurred for any work that has begun under your username and password.

15. Updating your personal information

If any of your personal information changes, you agree to notify us promptly, either by logging into seeflow.co.nz and updating your account yourself, or by contacting us.

16. Contacting you

You agree that we may contact you to notify you about:

  • Your online access
  • Your use of seeflow.co.nz
  • Changes to the seeflow.co.nz service
  • New Deafradio products, services and promotions; and
  • Any other information necessary for the operation and security of seeflow.co.nz
  • You agree that we may contact you within a reasonable timeframe after your membership has ceased from time to time to notify you about new Deafradio products, services and promotions until you let us know you wish to opt out of these notifications.

17. Newsletters

All seeflow.co.nz members will automatically receive our Seeflow newsletter. To unsubscribe, click on the link at the end of each newsletter and follow the instructions. Removal from the newsletter circulation does not exempt members from receiving essential service information from Seeflow, or inhibit their use of the site in any way.

18. Cancelling your Seeflow membership

You may cancel your Seeflow membership at any time. To do this, access "My Account" > “Settings and extras” > “DELETE MY ACCOUNT”. You can also call or txt 0225 DEAFRADIO (0225 332372) to discuss, or email us. When you cancel your membership, your access to seeflow.co.nz ceases immediately. Any outstanding charges remain your liability, and normal payment terms apply.

You agree that we may contact you within a reasonable timeframe after you have cancelled your Seeflow membership from time to time to notify you about new Deafradio products, services and promotions until you let us know you wish to opt out of these notifications.

c) Ordering Seeflow services online

20. Requsting services

The following services can be purchased online at seeflow.co.nz:

  • NZSL Letters, enabling Government departments, other services, and individuals to produce public information, or correspondence to individual clients, accessible in NZSL and able to be viewed and downloaded via seeflow.co.nz for a limited period.
  • English to NZSL translation, which enables people to receive translations of information written in English via video in NZSL. Translations are accessible, viewable and able to be downloaded from seeflow.co.nz for a limited period.
  • NZSL to English translation, which enables NZSL users, or others receiving information in NZSL (such as government select committees or other organisations permitting correspondence to be submitted in NZSL) to submit a video document, or record a video document on the seeflow.co.nz website, which is then translated to written English which can be viewed and downloaded via seeflow.co.nz for a limited period.
  • English Grammar Check, enabling any individual to submit a document in written English, which Seeflow will assess and modify according to the preferences of the user (including register and grammatical correctness). The final document can be viewed and downloaded via seeflow.co.nz for a limited period.

Any individual or organisation via a membership registration process can request Seeflow translation services.

While Seeflow will do all we can to fulfil any reasonable request, we reserve the right to refuse to undertake any requested assignment. Such reasons for refusal may include objectionable content (such as material of a sexual nature, or otherwise involving statements about a named third party that can reasonably be expected to harm the dignity of the translator), or the content being beyond our capabilities or otherwise unsuited to a plain translation format, or that we are unable to fulfil a request in the demanded timeframe. Seeflow may communicate reasons for refusal, but reserves the right to refuse without explanation.

d) Quotes

21. What do I need to provide for a quote?

All translations are based on the document(s) or video(s) to be translated (“the Source Material”) and instructions provided by you. Any changes or amendments to the Source Material or your instructions after the service has been submitted and agreed to, may incur additional costs, and affect the agreed deadline.

22. Quote validity

All quotes are based on the Source Material and your instructions and are valid for 30 days. Although every effort is made for quotes to be as accurate as possible, Seeflow reserves the right to change quotes if the translation of the Source Material requires significantly more work than anticipated. Seeflow will inform you of any changes to the agreed quote. If no agreement can be reached, Seeflow will invoice you only for the work carried out up to that point, or complete the amount of work possible up to the cost of the original quote.

23. Changes to the quote

Seeflow’s translation processes usually involve two translators working on the Source Material to minimise the risk of errors and are carried out using reasonable skill and care in accordance with relevant industry practise. Extra fees will apply if you request the translation to be carried out differently, for example by employing an additional technical proof-reader. Please discuss such requirements with us prior to the commencement of the translation.

e) Terms of Payment

24. Prices

All prices are stated in New Zealand dollars (NZD) and include Goods and Services Tax (GST). Due to the individual nature of each assignment, it is very difficult to produce exact pricing without seeing the Source Material first. Therefore any pricing on the seeflow.co.nz website is meant as a guide only, and quotes are advisable until you get a feel for the costs involved in each assignment.

25. Price changes

We reserve the right to increase or decrease fees or to introduce new prices for our products and services at any time. Any such changes will be published in advance on seeflow.co.nz.

26. Methods of payment

Payment for all services ordered and provided via seeflow.co.nz must be by either electronic bank transfer, or by cheque with prior agreement only.

27. Contacting a third party on your behalf

In order for a translation to commence, you must submit a payment option under “Your account”.

  • Workbridge
    By selecting this option, you are giving Seeflow permission to contact Workbridge on your behalf and confirm that you are registered, and that sufficient funds are available to complete your request. If there are sufficient funds to complete the translation, we will go ahead and complete the job and invoice Workbridge. All personal information about you held by Workbridge is confidential, and we do not need to know any other information, only that you are registered and have enough funds remaining for the job to proceed.

  • Employer
    By selecting this option, you are giving Seeflow permission to contact your employer to confirm employment and that they agree to cover the cost of requested translations. Alternatively, you may prefer to confirm this with your employer and provide us with a letter of confirmation. However in this case if your employer refuses payment for any reason, then you will instead become liable for any and all charges relating to the work undertaken.

  • Personal
    By selecting this option, you are agreeing to personally cover the cost of any services requested and agreed to and undertaken by Seeflow.

28. Terms of payment

Unless previously agreed to in writing, all invoices should be fully settled no later than the 20th of the month following receipt of the invoice.

29. Problems with payments

If there is a problem charging Workbridge, your employer, or any other funder, or we do not receive payment owing from you, we will contact you at your most recently updated email address. If we are unable to contact you by email, we reserve the right to suspend or terminate your access to seeflow.co.nz. Continued lack of payment may require Seeflow to contact a collection agency to recover the charges from you.

f) Warranties and Liabilities

30. Accuracy of translation

Seeflow will do its best to ensure that the final Translation meets your specific requirements and is error-free. However, all translations can vary linguistically depending on their nature and purpose, the target audience and the source text. The fact that there is more than one possible interpretation of the Source Material and that it could be translated differently does not entitle you to refuse payment or reject the final Translation as unsatisfactory.

Seeflow warrants that the final Translation is, within the limits as described above, an accurate translation of the Source Material. Seeflow is not liable for any subsequent changes by yourself to the final Translation regardless of their nature and whether they are made to the text, video, layout or formatting.

31. Review period

You shall raise any issues regarding the final Translation within 30 days of receipt. If you request a review of the whole or part of the final Translation, such review will be undertaken for an appropriate fee which will be agreed between the parties. Seeflow may, at its sole discretion, waive all or part of the fee if the review finds any significant errors in the final Translation.

32. Indemnity

Seeflow shall not be liable for any loss of profits, business, contracts, revenue, damage to your reputation or goodwill, anticipated savings, and or any other indirect or consequential loss or damage whatsoever arising out of or in relation to the final Translation.

g) Intellectual Property & Copyright

33. Intellectual Property rights

You warrant that the Source Material and the final Translation do not infringe any intellectual property rights and will indemnify Seeflow for any costs, claims, or damages arising out of the Agreement, including, but not limited to management time, legal fees, and may at its own cost defend or settle, any claim, action or proceedings brought against Seeflow, based upon a claim of intellectual property rights infringement in relation to the Source Material or final Translation.

34. Integrity of service

The intellectual property in the final Translation shall be vested in you once full payment has been received. However such rights do not extend to the ability to on-sell Seeflow services to a third party. Deafradio provides service direct to the public and government and other organisations via its seeflow.co.nz service and website. Any such attempt to develop a sub-contracting arrangement without our prior written permission may result in appropriate action.

35. Translation retention

In order to ensure high quality translation services to you, including consistent signs and terminology, Deafradio may elect to retain one copy of the Source Material and final Translation for internal use only (for example as reference material in a series of correspondence to ensure we can recall the context). The purpose of this is purely to enhance the quality of our service to you.

Deafradio will also retain a copy of the Source Material and of the translation if you refuse payment for the final translation or reject it as unsatisfactory, so that we can assess your claim. Once settled, and if the terms above do not apply, the copies will be deleted.

While retained, Deafradio will ensure the confidentiality of the material and member details within our secure system and server.
